1. Acceptance of these terms
These Terms of Service (“Terms”) form an agreement between you and [LEGAL_COMPANY_NAME], which publishes OrderPad under the BuddyApp product name (“BuddyApp”, “we”, “us”, or “our”). By downloading, installing, accessing, or using OrderPad, you agree to these Terms and the OrderPad Privacy Policy.
If you do not agree, do not use the app. If you use OrderPad for a business or organization, you confirm that you have authority to accept these Terms on its behalf; “you” then includes that business or organization.

OrderPad is intended for authorized staff and operators of cafés, restaurants, and similar businesses. You must be legally able to enter into these Terms and must use the app only with the authorization of the business whose operations and records you manage.
3. Limited license
Subject to these Terms, BuddyApp grants you a limited, personal or internal-business, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use OrderPad on supported devices for lawful business operations.
The app is licensed, not sold. Except where applicable law permits otherwise, you may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, decompile, bypass technical controls, or create derivative works from OrderPad.
4. Your operational and legal responsibilities
OrderPad records the information that users enter. You are responsible for checking its accuracy and deciding whether it is suitable for your business.
- Maintain accurate products, prices, modifiers, tax settings, totals, payment methods, and payment status.
- Control staff access to devices and ensure staff use OrderPad appropriately.
- Obtain any permissions or notices needed before entering personal or business information.
- Retain receipts, reports, closing records, and other documents for the period required by your business or applicable law.
- Comply with tax, invoicing, employment, consumer, accessibility, privacy, food-service, and other requirements that apply to your operations.
5. Operational support tool only
OrderPad is an order-taking and point-of-sale support tool. It is not an accounting, tax, legal, banking, card-acquiring, money-transmission, or online payment-processing service. Recording a payment method or status does not collect, transfer, settle, verify, or guarantee payment.
You remain responsible for reconciling sales, confirming payment, calculating and reporting taxes, issuing legally sufficient receipts or invoices, and obtaining professional advice when needed.
6. Local storage, backup, and restoration
OrderPad primarily stores data locally and is designed to work offline. BuddyApp does not currently operate a cloud backend that automatically stores or synchronizes your app data.
You are responsible for making suitable backups, protecting exported files, confirming that a backup can be restored, and preserving separate copies where appropriate. Backup files may omit media such as product photos, logos, and QR images. Restoring another backup, clearing application data, using “Clear all data”, losing a device, device failure, operating-system actions, storage corruption, or uninstalling the app may cause permanent data loss.
7. Devices, printers, and third-party hardware
Features depend on the device, operating system, permissions, Bluetooth environment, printer model, drivers, paper format, network conditions, and third-party hardware or services. Compatibility can change after an operating-system, printer-firmware, app, or platform update.
BuddyApp does not guarantee that every printer, peripheral, device, or configuration will work with OrderPad. Test critical workflows, receipt formatting, and restoration before relying on them in live operations.
8. Prohibited use
You must not use OrderPad to:
- Break the law, infringe another person’s rights, or facilitate fraud, deception, or harmful activity.
- Enter or disclose information that you are not authorized to use.
- Disrupt, probe, damage, overload, or bypass the app or its security and technical controls.
- Distribute malicious code or use the app in a way that puts devices, people, businesses, or systems at unreasonable risk.
- Misrepresent OrderPad as a certified accounting, tax, banking, or payment-processing service.
9. Intellectual property
OrderPad, including its software, visual design, documentation, names, and original content, is owned by BuddyApp or its licensors and is protected by applicable intellectual-property laws. These Terms do not transfer ownership to you.
You retain rights in the business content and records you enter. You represent that you have the rights and authority needed to use that content in OrderPad.
10. Updates and feature changes
We may provide updates, fixes, security improvements, change or remove features, change compatibility requirements, or discontinue distribution of OrderPad. An update may be required for continued compatibility or support.
Review release information and test material changes before using an updated version in live business operations. We do not promise that every feature or historical version will remain available.
11. Service availability
Although OrderPad is designed to work offline, it may be unavailable or function differently because of device failure, low storage, permissions, operating-system behavior, hardware faults, updates, maintenance, or circumstances outside BuddyApp’s control.
Maintain practical fallback procedures for taking orders, confirming payments, printing receipts, and preserving required business records.
12. Disclaimer of warranties
To the maximum extent permitted by applicable law, OrderPad is provided “as is” and “as available”. BuddyApp disclaims warranties that the app will be uninterrupted, error-free, secure, compatible with every device or printer, or suitable for every legal, tax, accounting, or operational requirement.
Nothing in these Terms excludes a warranty, guarantee, or consumer right that cannot lawfully be excluded.
13. Limitation of liability
To the maximum extent permitted by applicable law, BuddyApp will not be liable for indirect, incidental, special, consequential, exemplary, or punitive loss, or for loss of profits, revenue, business opportunity, goodwill, or data arising from or related to OrderPad.
Where liability cannot be excluded, it will be limited only to the extent reasonably permitted by applicable law. These limitations do not apply where exclusion or limitation is prohibited, including liability that applicable law requires to remain unrestricted.
14. Suspension and termination
You may stop using OrderPad at any time and may terminate this agreement by uninstalling the app. Deleting or uninstalling the app may remove local data, so make a suitable backup first.
BuddyApp may suspend distribution or support, revoke the license, or terminate these Terms if you materially breach them or where reasonably necessary to protect rights, users, systems, or comply with law. Because OrderPad currently has no staff account or cloud backend, BuddyApp does not remotely control your local records. Provisions that by their nature should continue—including ownership, disclaimers, liability limits, and dispute terms—survive termination.
15. Governing law and disputes
These Terms are governed by [GOVERNING_LAW], without regard to conflict-of-law principles, except where mandatory local law provides otherwise.

16. Changes to these terms
We may update these Terms to reflect changes to OrderPad, our practices, or applicable requirements. The revised version will show a new effective or last-updated date. Continued use after revised Terms take effect means you accept them to the extent permitted by law.
